Interações transjudiciais e transjudicialismo: sobre a linguagem irônica no direito internacional

Resumo


As interações entre cortes nacionais e internacionais estão se expandindo
pari passu com a ampliação dos poderes do Judiciário ao longo do
sistema-mundo e a proliferação do número de cortes internacionais e supranacionais.
Reconhecendo que as interações transjudiciais confi guram um
fenômeno sociológico complexo, o presente estudo pretende concentrar-se
sobre o seus aspectos éticos, políticos e epistemológicos. Um dos objetivos
da pesquisa é sustentar a íntima relação entre as idéias e valores universais
da sociedade ocidental, do capitalismo histórico e da linguagem irônica do
direito internacional e que tal relação constitui o fundamento primeiro do
transjudicialismo, e defender o paradigma da complexidade como modelo
teórico mais adequado para se refl etir sobre o fenômeno. Adotar-se-á, fundamentalmente,
uma análise teórica, que tem como pano de fundo uma crítica
à perspectiva comunitarista subjacente ao transjudicialismo, embora não
raras as incursões sobre os próprios precedentes invocados nos episódios de
interação transjudicial.
