The European Court of Human Rights Decision on the ´Burqa Ban´ and the critical analysis of the Pragmatic experimental logic

Resumen


The pragmatic philosophy of J. Dewey and C. S. Peirce, associated with the legal realism of Holmes, were used in the present study as a methodological instrument to critically analyze the decision of the European Court of Human Rights, ruling upholding the French ban on the wearing in public of any piece of clothing designed to fully conceal the face (case of S.A.S. v. France, judgment delivered on 1 July 2014).
