A proteção da identidade de gênero na jurisprudência da Corte Europeia de Direitos Humanos

Resumo


O trabalho investiga a proteção das pessoas trans na jurisprudência da Corte Europeia de Direitos Humanos. A análise jurisprudencial é justificada na ausência de disposições legislativas sobre a proteção LGBTI no direito internacional, no âmbito global e regional. Valendo-se do marco teórico da teoria da justiça de Nancy Fraser, questiona-se se as decisões da Corte auxiliam no reconhecimento dessa população. O estudo se divide em três partes: revisão bibliográfica acerca do marco teórico e da especificação dos direitos humanos; pesquisa empírica e exploratória sobre as decisões da Corte Europeia em matéria de identidade de gênero; análise crítica dos dados encontrados na fase exploratória. Os resultados obtidos apontam para uma parcial contribuição da jurisprudência do órgão para as políticas de reconhecimento, que, apesar de apresentar certo grau de especificação, são fundamentadas em discursos que não contribuem para a reconfiguração dos padrões de subordinação social e cultural da população trans.
